Privacy Policy
Copenhagen Trackers collects your data from the use of Copenhagen Trackers tracking devices, Copenhagen Trackers website, Copenhagen Trackers App and API, which helps optimize your business and your everyday life. We fully understand that you value your privacy. We believe that privacy is a human right and that you should have the ability to decide how your data is used and by whom. This is the background to our privacy policy:

We will always keep you informed about your data.
We make sure you know what data from or about you we use, why we use it, how long we use it and who has the ability to use it. We give you the right to have full control over your data. We consider data from or about you to be yours. We only use data for the purposes you have given us permission to or that we have collected from you. Copenhagen Trackers is the data processor and you are the data controller in accordance with the Data Protection Regulation in Denmark and the General Data Protection Regulation (GDPR) in the EU. Copenhagen Trackers may only act on your instructions. Copenhagen Trackers shall implement appropriate technical and organizational security measures to protect data against accidental or unlawful use, loss or alteration and against unauthorized disclosure, misuse or other processing in breach of the provisions of the GDPR in Denmark and the General Data Protection Regulation (GDPR) in the EU. Upon your request, Copenhagen Trackers shall provide you with sufficient information within a reasonable time to enable you to ensure that we comply with the requirements for appropriate technical and organizational security measures.

We protect your data.
Your data is always yours. We think this way to protect your data as well as we reasonably can, to prevent it from falling into the wrong hands. We do this by encrypting, anonymising or pseudonymising your data. In this way, we keep your data safe. We will tell you what data from or about you we use, why we use it, how long we use it, who can use it and where it is stored. We will only use your data for the purposes we have specified to you. We keep as little of your data as possible and only for as long as we need it. When we no longer need your data, we destroy or irreversibly anonymise it so that it is no longer linked to you. If we ask for your permission to use your data for specific purposes, we also always allow you to withdraw your permission again. We protect your data from unauthorised access and accidental loss as best we reasonably can. If we allow others to use your information on our behalf, we will ensure that they act in accordance with our privacy policy. If we share your data with others, we will first ask for your permission unless there is a legal obligation prohibiting us from asking. We are open to any questions you may have about the use of your data, which we are happy to answer.

As we are based in Denmark in Europe, the General Data Protection Regulation (GDPR) always applies. These laws are considered to be the most comprehensive in the world. They provide a high level of security by only allowing us to use your data when all the conditions of these laws are met. Our corporate policy on privacy and processing of personal data reflects these laws and we apply this privacy policy globally.
 

Definitions
Personal Data: information relating to an identified or identifiable natural person (registered user), an identifiable person is one who can be identified, directly or indirectly, by reference to an identification number or to one or more factors specific to his/her physical, physiological, mental, economic, cultural or social identity.

Processing of personal data: one or more operations which are performed upon personal data, such as collection, recording, organisation, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, blocking, erasure or destruction.

Copenhagen Trackers processes personal data fairly and lawfully.
Copenhagen Trackers collects personal data for specified, explicit and legitimate purposes and will not use personal data in a manner incompatible with those purposes.

Copenhagen Trackers will ensure that personal data is adequate, relevant and does not contain unnecessary information in relation to the purposes for which it is collected and/or used.

Copenhagen Trackers will only retain personal data that allows identification of users until it no longer serves the necessary purpose for which the personal data was collected. April 2018

Copenhagen Trackers only processes personal data if:

(a) the user has unambiguously consented; or

(b) processing is necessary for the performance of a contract to which the user is party or in order to take steps at the request of the user prior to entering into a contract; or

(c) processing is necessary for compliance with a legal obligation to which Copenhagen Trackers is subject; or

(d) processing is necessary for the purposes of the legitimate interests of Copenhagen Trackers, unless such interests are overridden by the fundamental rights and freedoms of the user and in particular his or her right to privacy. Copenhagen Trackers will not use personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership or personal data concerning health or sexual orientation.

We process data on your behalf and only pursuant to a contract or consent from you. You can access, correct or delete your data from our system at any time. We only collect data from you via our Copenhagen Trackers tracking devices and system, and no other data will be sent to Copenhagen Trackers.

The data we collect is not limited to the date taken from Copenhagen Trackers tracking devices such as: Latitudes, Longitudes, Temperature, Light Intensity, Movements etc. We always have the possibility to access and correct data on your behalf, where only relevant persons from Copenhagen Trackers have access to your data. The employees who have access to your data do so solely to assist you in any way possible as well as to collect statistical data for further improvements of our system.

Copenhagen Trackers has implemented appropriate technical and organisational measures to protect personal data against accidental or unlawful destruction or accidental loss, alteration, unauthorised disclosure or access, in particular where the processing involves the transmission of personal data over a network, and against all other unlawful forms of processing. Copenhagen Trackers does this by having a level of security appropriate to the risks represented by the processing and the nature of the personal data to be protected. In the case of processing of data carried out on behalf of Copenhagen Trackers, Copenhagen Trackers will choose a processor that provides sufficient guarantees as to the technical security measures and organisational measures applicable to the processing to be carried out and will ensure compliance with these measures. In these cases, Copenhagen Trackers ensures that the processing is subject to a contract binding the processor to the controller and providing in particular that:

(a) the processor shall act only on instructions from Copenhagen Trackers

1.b) The provisions of this Privacy Policy apply to the processor. 

Copenhagen Trackers processes personal data in the European Economic Community (EEC). In cases where personal data are transferred or processed outside the EEC by Copenhagen Trackers or on Copenhagen Trackers' behalf, Copenhagen Trackers ensures that there are adequate safeguards with respect to the protection of the privacy and fundamental rights and freedoms of individuals and with respect to the exercise of the corresponding rights by using appropriate contractual provisions or other acceptable legally binding instruments. In the event that Copenhagen Trackers stores data elsewhere or accesses (any) data already stored in a user's device, Copenhagen Trackers will ensure that the user in question has given consent after having been provided with clear and relevant information regarding the purpose of the processing. This does not prevent Copenhagen Trackers from technical storage or access for the sole purpose of carrying out the transmission of a message via an electronic communications network or as strictly necessary for Copenhagen Trackers to provide a service expressly requested by the user.

Data we collect
When you use our sites, our products and our services, we collect data from and about you. The data we collect depends on what you use and how you use it. In general, there are 3 categories of data we collect and use:

Data you provide
This is the data you enter yourself when you use our pages, products and services. This data includes, for example, your name, your email address, your address and geofence locations, your phone number, etc.

Data collected by sensors
Many of our products are equipped with one or more sensors or use the sensors for the devices they run on. Examples of sensors are GPS positions, temperature, GSM cell information, radio signal strength, movements etc. When these sensors are activated, they automatically collect data. Depending on the purpose for which data has been collected, this data in combination with other data identifying you or your device may be sent to Copenhagen Trackers and others for later use.

Metadata
Metadata refers to data that is collected or automatically generated while you use Copenhagen Trackers pages, products or services. In most cases, metadata is collected or generated via a computing device or a transmission of data over computer networks, such as the Internet. This data includes user interface and other device usage, IP addresses, unique device identifiers, cookies and computer activity records. Copenhagen Trackers refrains from selling or publishing the data, except by written agreement with the right holder or under court order. However, Copenhagen Trackers has the right to analyze and publish market statistics based, among other things, on anonymous operational data from Copenhagen Trackers tracking devices.

Copenhagen Trackers account
We will occasionally use your email address to send you information related to the products and services registered in your Copenhagen Trackers account. We will only do this if there are updates that you need to be aware of to ensure that you can use your product safely and reliably without interruption, or if there is a legitimate reason to contact you. Should you wish to delete your Copenhagen Trackers account, please contact Copenhagen Trackers directly. We will not share your Copenhagen Trackers account information with anyone else unless they are working under our responsibility, according to our instructions, or when expressly and legally required to do so by legal process. If you are not satisfied with your rights under this statement, such as the right to transfer data, the right to amend data or the right to withdraw your consent, you can always contact the Data Protection Officer.
